Unsure How to Handle a Ticket?
What is my next step after I receive a traffic/navigational ticket?
• If you are pleading “Guilty” complete section A. If you are pleading “Not Guilty” and want to request a reduction, then complete section B. You must return your ticket to court by mail, email OR in person by the appearance date located at the bottom, left side of the ticket. Remember to keep a copy of your ticket.
NOTE: By pleading “Guilty” you waive your right to a trial at which the People of the State of New York, represented by the prosecution, must prove beyond a reasonable doubt that you committed the offense alleged in the accusatory instrument. A plea of guilty will subject you to sentencing, by the Judge presiding, to any legally authorized sentence. You may withdraw, with the Court’s permission, your plea of guilty at any time prior to sentencing and exercise your right to a trial.
Do I have to appear in court?
•No, you do not need to appear in court for a traffic ticket unless it is a misdemeanor or felony offense. If pleading guilty to your ticket(s), complete section A and email/mail it to the court. If you are pleading NOT GUILTY you will need to visit the DA’s website at https://co.jefferson.ny.us/departments/DistrictAttorney/vehicle-and-traffic-charges and follow the directions by clicking on “INFORMATIONAL PACKET FOR TRAFFIC REDUCTIONS.”
• If your ticket is a misdemeanor you MUST appear in court.
What do I do if I receive a ticket for an equipment violation?
• You have 24 hours to get your vehicle repaired. Once repaired, have a mechanic or police officer sign the “Statement of Correction for Equipment Defect” portion of your ticket and return it to court on or before your appearance date. If you do not have the “Statement of Correction for Equipment Defect” form then attach the receipt of correction/payment and mail back to the court.
What is my fine?
• The judge cannot issue a fine amount until a plea has been received. Once a plea has been received the judge will then review your case and assess a fine amount in accordance with the NY State law.
What if I’m looking for a reduced plea (plea bargain)?
• In addition to mailing the court your plea, you also need to visit the DA’s website
https://co.jefferson.ny.us/departments/DistrictAttorney/vehicle-and-traffic-charges and follow the directions provided.
